Online Sweepstakes

Get People Talking

Social media. Facebook, Twitter, smart phones, text messaging and other social platforms are the key links for distributing your content, starting a dialog with your customers and creating a community.

But be careful if you ask consumers to invite their friends. Starting in 2008, the FTC asserted that CAN-SPAM (Controlling the Assault of Non-Solicited Pornography and Marketing Act; 15 USC §7701) applied to online sweepstakes offering additional entries for forwarding emails or invitations to friends. The Children's Online Privacy Protection Act (COPPA) also applies and makes it risky to target anyone under 18 years old either deliberately or inadvertently. See www.ftc.gov.

If you allow others to post content, you may become liable for copyright infringement, torts, defamation or other intellectual property violations. At the very least there must be a review and take-down policy that is scrupulously followed.

We can help you get people talking while safely navigating the legal issues.
